What Giovanni Point's governing documents say
Giovanni Point is a planned community in Wilmington, NC, governed by a homeowners' association (HOA) under the North Carolina Planned Community Act. This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all lot owners. It establishes the HOA, defines common elements, and sets rules for assessments, property use, and architectural control.
- What you own & maintain: You own your lot (the land and any dwelling). The association owns and maintains the common elements (e.g., private roads, stormwater ponds, open space). You must maintain your lot, including any easement areas (e.g., utility strips), unless a public authority or utility is responsible.
- Assessments & fees: All lot owners must pay annual assessments, special assessments (approved by 2/3 vote), insurance assessments, ad valorem tax assessments for common elements, and a one-time $200 working capital assessment at purchase. Assessments are a lien on the lot and a personal obligation of the owner when due.
- Architectural review: An Architectural Control Committee (appointed by the developer during the Declarant Control Period, or by the HOA board thereafter) must approve all plans and specifications for construction or modifications. The committee may delegate to a Master Architectural Control Committee.
- Developer rights: The developer (Declarant) retains special rights during the Declarant Control Period (until December 31, 2006, or when Class A votes equal Class B votes, whichever is earlier). These include the right to appoint the HOA board, annex additional land, amend the declaration without owner approval (before first lot sale), and re-plat lots.
- Property use & easements: The association and developer have easements over lots for utilities, drainage, and maintenance. Emergency services may enter any lot. Owners cannot obstruct easement areas. The association may enter a lot to perform maintenance if the owner fails to do so.
- Insurance: The association must maintain insurance on common elements (fire, hazards, liability) as required by the Act. Owners should carry their own insurance; association insurance does not cover owner property.
- What this document doesn't cover: This excerpt does not specify rules on pets, leasing, age restrictions, parking, or rental minimums. Those may be in other sections of the declaration, the Master Declaration, or association rules.
