You own your individual unit and an undivided share of the common elements, which the association maintains and insures. The declaration governs unit ownership, common expenses, use restrictions, and insurance requirements.
- What you own & maintain: You own the interior finished surfaces (plaster, paint, wallpaper) and interior partitions of your unit. Perimeter walls, floors, ceilings, pipes, wires, and utility lines serving more than one unit are common elements. Balconies, decks, or patios are reserved for the exclusive use of the adjacent unit.
- Assessments & common expenses: The association levies assessments to cover common expenses, with each unit's share based on the percentages in Exhibit C. The association has a lien on each unit for unpaid assessments, including reasonable attorneys' fees.
- Occupancy & use: Units may be used only as private dwellings. No activity that increases insurance rates, obstructs other owners, or creates unreasonable noise, odors, or nuisances is permitted.
- Pets: Pets are allowed as long as they do not constitute a nuisance or unreasonably interfere with other owners' quiet enjoyment.
- Parking: Common elements include parking areas. Each unit is entitled to at least one designated parking space, subject to association regulations.
