Sandpiper Ocean Front Townhouses is a three-unit condominium community in Wrightsville Beach, NC. You own your individual townhouse unit and share ownership of the common elements (land, foundations, roofs, exterior walls, etc.) with the other two owners. The association maintains the common areas and carries master insurance, funded by monthly assessments based on your unit's percentage interest.
- What you own & maintain: You own the interior of your three-story unit, including all plumbing, electrical, HVAC, floor and wall coverings, windows, and doors. You must maintain these at your own expense. The association maintains the common elements (land, foundations, roofs, exterior walls, chimneys, and the limited common areas like the land between Arringdale Street and your unit's north wall and all decks).
- Common expenses & assessments: You pay a monthly assessment equal to your unit's pro-rata share (Unit 1: 35.92%, Unit 2: 31.85%, Unit 3: 32.23%) of the estimated total operating expenses, including a management fee. Payments are due on the first of each month and bear interest at the maximum legal rate if late.
- Leasing & rentals: If you want to sell or lease your unit, you must first offer it to the association at the same price and terms as the highest bona fide offer. The association has 30 days to exercise its option. Leases are subject to all condominium documents. Transfers to a spouse, parents, or lineal descendants (including adopted children) are exempt from this right of first refusal.
- Pets: No animals, livestock, or poultry may be raised, bred, or kept in any unit or common area except as permitted by association rules and regulations.
- Use restrictions: Units may only be used as private residences. No signs may be displayed without board approval. No noxious or offensive activities are allowed. Nothing may be stored in common areas without board consent, and common areas may not be obstructed.
- Insurance & damage: The association carries master property insurance at 100% replacement cost and public liability insurance. You may insure your personal property separately. If the building is more than two-thirds destroyed and two-thirds of owners vote not to rebuild, the property is owned as tenants in common and may be partitioned.
- Amendments: The declaration may be amended by a vote of at least two-thirds of all unit ownership (one vote per unit). Amendments must be recorded in the county register of deeds office.
