Rogue Townes is a townhome community in Wilmington, NC, with four units (802 Units A–D) in a single building. It is governed by a declaration that allows mixed-use: ground-floor general office or retail (limited to one art gallery, no other retail), and upper floors for residential use only. The community is designed as owner-occupied, but rentals are permitted with association approval and strict rules.
- Mixed-use & commercial restrictions: Ground floors may be used for general office (e.g., architects, lawyers, CPAs) or one art gallery, with hours limited to 8:00 AM–6:00 PM daily (extended to 9:00 PM for monthly special events). No retail sales (except art gallery), no uses requiring a special use permit, and no uses prohibited by city code. All signage must be inside the unit, unlit, and no larger than 1 ft high by 3 ft wide; two signs per unit max.
- Leasing & rentals: Rentals of less than the whole unit are prohibited. Leases must prohibit pets. Unit owners must submit leases for association approval, provide copies to the association, and ensure tenants maintain renters insurance. The association may terminate leases and evict tenants for rule violations. No lease will be approved if the owner is delinquent on dues or fines.

First purchasers pay a working capital assessment of $360 (two quarters). Special assessments may be levied for common expenses not covered by dues. Unpaid assessments create a lien on the unit.
- Architectural & exterior changes: No structural modifications, exterior changes (including painting, satellite dishes, antennas), or alterations to common elements or party walls without unanimous written approval of all unit owners. Exterior color changes require the entire building's color scheme to change and unanimous approval.

Roof replacement, common landing, and party wall costs are shared pro rata among all units, unless damage is caused by one unit (then that unit bears the cost).
