What Port City Marina Yacht Club's governing documents say
Port City Marina Yacht Club is a marina community in Wilmington, NC, where you own a membership that gives you exclusive use of a specific boat slip and shared access to common areas. The association maintains the marina facility, docks, and common areas, funded by member assessments. This is not a residential community—it's a boat-slip ownership arrangement.
- What you own & maintain: You own a membership that entitles you to exclusive use of a designated boat slip. The association owns and maintains the common areas (docks, piers, parking, landscaping, etc.) and is responsible for permits, insurance, and maintenance dredging. The concrete pier and fuel system remain with the developer unless conveyed later.
- Membership types & voting: There are two membership classes: Charter (held by the developer, 5 votes each, freely transferable) and Class A (after sale by developer, 1 vote each). Charter memberships for transient slips are exempt from regular assessments until sold; other charter memberships are exempt for 5 years from the declaration date.
- Assessments & fees: Regular and special assessments are levied on members (except exempt charter memberships). Special assessments over $1,000 per membership per year require majority vote. Delinquent assessments accrue 12% annual interest and become a lien on the membership. The association may charge a $100 fee for a payment status statement.
- Leasing & rentals: Members may delegate use of their boat slip and common areas to family, guests, tenants, or contract purchasers only by written assignment on association-approved forms. No specific minimum lease term is stated, but transfers of membership require association approval (except charter memberships).
- Use restrictions & rules: No obnoxious or offensive activity is allowed. The board can adopt rules for common areas, boat slips, and extreme weather (e.g., mandatory boat removal during hurricanes). Violations can result in a special assessment up to $300 per occurrence plus $100 per day after 10 days' notice.
- Developer rights & easements: The developer reserves broad easements over common areas for utility installation, development of adjacent property, and access to transient slips. The developer may host events on the pier with 5 days' notice. The association must maintain all permits (CAMA, stormwater) and indemnify the developer.
- What this document doesn't cover: This declaration does not address residential use, age restrictions, pet policies, parking rules, or architectural standards. Those may be covered in separate bylaws or rules and regulations.
