Oak Hill Subdivision is a standard single-family home HOA in Wilmington, NC. These covenants run with the land and bind all lot owners, with an HOA to be formed once 70% of lots are sold.
- Minimum home size & architectural review: Residences must have at least 1,000 sq ft of heated living area. All construction plans must be approved by the Declarants (or later the HOA); approval is deemed given if not rejected within 10 days of submission.
- Prohibited structures: No house trailers, single-wide mobile homes, tents, shacks, or temporary structures are allowed as residences or storage. Double-wide mobile homes are permitted if approved and underpinned. Temporary storage for construction is allowed but must be removed promptly after completion.
- Accessory buildings: Only one accessory building (including detached garages) is allowed per lot.
- Setbacks & site plan approval: No fixed setback lines are established, but the Declarants (later HOA) must approve the site plan and location of any structure. Minimum setbacks required by local government must be followed.
- Pets: Only normal household pets are allowed; no other animals may be kept.
- Parking & vehicles: Inoperative or unlicensed vehicles may not be stored or parked on any lot or street for more than 30 days.
- Road maintenance & common areas: Bonaire Road and any other common areas will be maintained by the Declarants until an HOA is formed, then conveyed to the HOA, which will be solely responsible for maintenance, taxes, and insurance. Each lot owner has an easement to use Bonaire Road for ingress/egress and normal purposes.
- HOA formation & assessments: An HOA will be formed when 70% of lots are sold. Annual assessments start at $35 per lot (max for first 2 years) and can be increased by 2/3 vote of members. Special assessments require 2/3 vote. Assessments are a lien on the lot, subordinate to first mortgages and property taxes. Delinquent assessments bear 8% interest and may be collected via lawsuit or foreclosure.
