Porters Crossing is a planned community in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that applies to all lot owners. It establishes the HOA, defines common elements, sets assessment rules, and includes architectural control and maintenance obligations.
- What you own & maintain: You own your lot and dwelling. The association maintains common elements (private roads, stormwater ponds, open space, the Old Nixon Cemetery, and the Active Recreation Area) and the front lawn of each lot. You are responsible for maintaining the rest of your lot, including back and side yards, and must sod your lot after construction.
- Assessments & fees: Annual assessments fund common area maintenance, insurance, and front lawn care. Special assessments require a 2/3 vote of owners (except to reimburse the developer). A one-time working capital assessment of $500 is due at purchase from the developer. Assessments are a lien on your lot if unpaid.
- Architectural review: An Architectural Control Committee (appointed by the developer during the Declarant Control Period, or by the board later) must approve any proposed grass sod species and likely other exterior changes. The document does not detail other architectural standards.
- Developer rights: The developer retains special rights during the Declarant Control Period (up to 10 years or until voluntarily surrendered), including the right to appoint the board, amend the declaration without owner vote for certain purposes, and replat or redesign lots and common elements.
