Kirkland Estates is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) that run with the land. These rules apply to all lot owners and are designed to maintain the area for attractive residential use.
- Land use & building type: All lots are for single-family residential use only. Modular construction is prohibited on most lots (except Lots 4, 6, 8, and 9). No mobile homes, trailers, or temporary structures are allowed without developer consent.
- Minimum house size & design: Houses must be at least 1,600 sq ft of heated floor space (excluding porches, garages, etc.). Two-story homes need at least 1,000 sq ft on the ground floor. Roof pitch must be at least 6/12, and shingles must be earth tones (browns, grays, blacks). Exterior materials are limited to conventional frame, wood, masonite, vinyl, brick, clay brick, or stucco; exposed foundations must be brick, stone, or stucco.
- Architectural & site review: All building and landscaping plans must be submitted to the developer for approval before construction. A plot plan showing the structure's location is required. No lot may be clear-cut without written consent. Setbacks follow county ordinances, but the developer controls site location to protect privacy and trees.
- Fences, signs & antennas: Chain-link fences are prohibited. Other fences and hedges need written approval; fences facing the street must be wood. No fence or hedge is allowed nearer the front lot line than the rear corners of the house. Only one 'For Sale' sign (max 5 sq ft) is allowed on improved lots. No outdoor antennas or radio/TV receivers without developer permission.
- Parking & vehicles: Each lot must have a paved driveway and off-street parking for at least 2 cars, built of concrete, asphalt, brick, or landscape pavers. No inoperable vehicles, vehicles without current registration/insurance, or vehicles larger than 3/4 ton (including buses, vans, school buses) are allowed. Boats must be stored inside or in the back yard, not visible from the street.
- Pets & nuisances: Household pets are allowed subject to county ordinances and leash laws. No domesticated farm animals or fowls. No noxious or offensive activities, and no plants, animals, or devices that are unsightly or diminish others' enjoyment.
- Maintenance & upkeep: Lot owners must keep their lot mowed and free of unsightly objects. The developer may enter and clean up at the owner's expense if the owner fails to do so after 15 days' notice. No yard sales or garage sales are permitted. Clotheslines are prohibited except portable stands not visible from the street.
- Utilities & easements: Water is supplied by private wells (not in front yards, must be screened). Sewage is by septic tank until county sewer is available; then owners must connect. Easements for utilities and drainage exist over the front, rear, and side 10 feet of each lot. Owners maintain drainage easements on their lots.
