What Porters Neck Plantation HOA's governing documents say
Porters Neck Plantation is a single-family home HOA in Wilmington, NC. This document is the full set of protective covenants that bind all lot owners. It covers what you can build, how you must maintain your lot, and the association's powers to collect dues and enforce rules.
- Single-family use only: All numbered lots are restricted to single-family residential use only. No commercial use is allowed, except the developer may use a structure for sales purposes.
- Architectural review: You must get prior approval from the Architectural Control Committee before any construction, landscaping, tree removal (trees 4 inches or larger), fences, satellite dishes, or other improvements. Plans must include a survey, elevations, and contractor info. Approval is deemed if no response within 30 days.
- Building size & setbacks: Minimum heated living area: 1,800 sq ft for single-level homes, 2,000 sq ft for two-level homes (2,000 sq ft if adjacent to golf course). Setbacks: at least 40 ft from street, 15 ft from side lot lines, 50 ft from waterways and rear lot lines (35 ft from golf course). No modular or pre-built homes allowed.
- Parking & vehicles: Boats, trailers, campers, RVs, and trucks rated one ton or larger must be kept inside a garage overnight. The association may adopt rules on parking and number of vehicles per lot.
- Pets & nuisances: The board may adopt rules restricting pets. Any activity deemed a nuisance by the association is prohibited, even if not specifically listed. Fines up to $100 per day for continuing nuisances.
- Assessments & dues: Annual dues are set by the board; initial assessment was $50 per lot. Dues for improved lots (with a building permit) are twice the unimproved rate. Special assessments require 70% vote of owners, but the board can levy emergency assessments without a vote. Unpaid assessments become a lien and can be foreclosed.
- Leasing & rentals: The board may adopt rules restricting rental use of homes. No specific lease term minimum is stated in these covenants.
- Golf course & club: Lots near the golf course assume risks from errant golf balls. Owners have no vested right to use the country club facilities; membership is separate. An easement allows golfers to retrieve balls from unfenced lots.
