Pine Marsh is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (Pine Marsh Property Owners' Association). These restrictive covenants apply to Lots 1–4 and bind all current and future owners. The rules focus on maintaining a high-end, uniform appearance and protecting water views.
- Architectural review: All construction, exterior alterations, grading, and landscaping must be approved in writing by the Declarant (or later the Association) before work begins. Approval can be denied for any reason, including aesthetics. Minimum home size is 2,500 sq ft enclosed, with an attached two-car garage. No log homes, no detached buildings (except approved greenhouses/storage/poolhouses), and no structures over two stories without approval.
- Landscaping & vegetation: No trees, shrubs, or vegetation may be removed, planted, or installed without prior written approval based on a submitted site/landscaping plan. All grass areas must be sodded and have underground sprinklers. Weeds, underbrush, and unsightly growth must be kept cut, and no refuse piles are allowed.
- Use restrictions: Lots are for single-family residential use only. No duplexes, apartments, trailers, mobile homes, or temporary structures (except contractor shelters during construction). No business, professional office, or religious/institutional use. No oil/gas drilling or mining. No hunting or discharging firearms.
- Pets: Only dogs, cats, and pet birds are allowed, in reasonable numbers for non-commercial purposes. Pets must be kept under control and not become a nuisance (e.g., excessive barking).
- Vehicles & parking: Each lot must provide off-street parking for two cars outside the garage. No boats or canoes (on or off trailers) may be parked overnight unless inside an enclosed garage. No junk or inoperable vehicles may be left in any yard.
- Signs & mailboxes: For-sale signs are limited to 2 ft x 2 ft, one on the lot and one at the subdivision entrance. All other signs (builder, realty, etc.) require Declarant approval and cannot be nailed to trees. Mailboxes and newspaper receptacles require approval of size, location, design, and material. A small owner-name sign (5 in x 20 in) is allowed with approval.
- Assessments & fees: Each lot owner must pay annual assessments set by the Association, initially capped at $1,000/year until 1988, then adjustable. Assessments become a lien on the lot if unpaid, with 10% annual interest. Additional assessments may be levied for emergencies. Separate fees may apply for amenities like pools or tennis courts.
- Leasing & rentals: If an owner wants to lease their property, the Declarant may require submission of the proposed lease for approval, and leasing may be subject to rules established by the Declarant or Association.
