Rockport is a single-family home HOA in Wilmington, NC. This Declaration of Covenants, Conditions, and Restrictions (CC&Rs) establishes the HOA and sets rules for lot owners, including architectural controls, use restrictions, and assessment obligations. It applies to all current and future owners, tenants, and occupants.
- What you own & maintain: You own your lot and the dwelling on it. The HOA maintains common areas, front yards, exterior surfaces (except roofs and glass), and drainage systems. You are responsible for roof and glass maintenance, and for landscaping and exterior upkeep if the HOA does not.
- Architectural review: All exterior changes (including painting, fences, and new structures) require prior written approval from the Declarant or Architectural Control Committee. Plans are deemed approved if no response within 30 days. Minimum dwelling size is 1,000 sq ft enclosed area; no structures over one story without approval.
- Use restrictions: Lots are for single-family residential use only. No noxious activities, temporary residences, boats, campers, or inoperable vehicles allowed. Pets (dogs, cats) are permitted but must be leashed and not for commercial purposes. No satellite dishes or outside antennas without permission.
- Assessments & fees: Annual assessments are set by the Board and can increase up to 5% per year without a vote; higher increases require 2/3 member approval. Special assessments for capital improvements also need 2/3 vote. A working capital assessment equal to two months' dues is due at closing. Assessments are a lien on the property.
- Leasing & rentals: The document does not restrict leasing or set minimum lease terms. However, all tenants must comply with the Declaration.
- Parking & vehicles: Off-street parking for at least two cars must be provided. No inoperable or unregistered vehicles, and no tractor-trailers. Vehicle repairs must be done in garages, not visible from the street.
- Signs & window coverings: Signs (including For Sale/Rent) require written permission, except as required by law. Window coverings visible from outside must be white or neutral. Exterior lights must be clear, white, or yellow bug bulbs.
