Crown Ridge is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions applies to all lot owners and sets rules for land use, architectural control, assessments, and common area maintenance.
- What you own & maintain: You own your lot and the house on it. The HOA owns and maintains the common areas (retention ponds and designated common area on the plat). You are responsible for maintaining your lot and buildings, and the HOA may enter your lot to maintain utility and drainage lines.
- Architectural review: All exterior construction, additions, or alterations (including fences, walls, and landscaping) require prior written approval from the Declarant or later the HOA's Architectural Control Committee. Plans are reviewed for harmony of design and location. Approval is deemed given if no response within 30 days.
- Minimum house size & building rules: Houses must have at least 1,150 square feet of enclosed dwelling area (excluding garages, decks, open porches). Only one single-family dwelling per lot, max two stories. Accessory buildings allowed only after main house is built. Exterior and landscaping must be completed within 3 months of construction start.
- Assessments & fees: Annual assessments start at $120 per lot (as of 2003) and can increase up to 10% per year without a vote. Special assessments for capital improvements require a 2/3 vote of each membership class. A working capital fee equal to the annual assessment is due at closing. Assessments are a lien on the property.
- Use restrictions: Lots are for single-family residential use only. No noxious activities, temporary structures, or recreational vehicles (boats, campers, trailers) without HOA consent. Pets allowed (dogs, cats) but must be leashed and not for commercial purposes. No outside antennas, no signs except approved 'For Sale' signs, and window coverings visible from outside must be white or neutral.
- Parking & vehicles: Each lot must provide off-street parking for at least 2 cars, constructed of concrete, brick, asphalt, or turfstone. Inoperable vehicles, vehicles without current registration/insurance, and tractor-trailers are prohibited and may be towed at owner's expense.
- Stormwater management: Maximum built-upon area per lot is 4,500 square feet (includes structures, pavement, gravel, etc., but not raised wood decking). All runoff must drain into the permitted stormwater system. These covenants cannot be altered without state approval.
- Amendment & duration: The covenants run for 20 years from recording (2003) and automatically renew for successive 10-year periods. Amendments require 90% lot owner approval during the first 20 years, and 75% thereafter. Amendments must be recorded.
