What Gardner Woods's governing documents say
Gardner Woods is a small, three-lot single-family home subdivision in Wilmington, NC. These covenants run with the land and bind all current and future lot owners. The community is governed by the lot owners themselves, with no homeowners association.
- Residential use & minimum size: Each lot is limited to one single-family home of at least 2,000 sq. ft. of heated living area (excluding porches, carports, and garages). Mobile homes, modular homes, and manufactured homes are prohibited.
- Animals: Only dogs, cats, pet birds, or other household pets are allowed, and they must not be kept for commercial purposes, must comply with local ordinances, and must not be a nuisance to other owners.
- Antennas & satellite dishes: No outside radio, television antennas, or satellite dishes may be erected without the written consent of all three lot owners.
- Lot maintenance & nuisance: Each owner must keep their lot clean and free of debris. No obnoxious, offensive, or unlawful activities are permitted, and nothing may become a nuisance to the neighborhood.
- Shared easement: Each lot owner has a 1/3 interest in a 30-foot access and utilities easement. All owners may use it, utility companies may place lines, and no blockage is allowed. Maintenance is shared equally among the three owners.
- Subdividing & boundary changes: No lot may be subdivided or its boundaries changed without the written consent of all three owners, and then only to correct minor setbacks or preserve trees, without significantly changing lot sizes.
- Duration & amendment: These covenants run for 20 years from August 31, 1995, and automatically renew for successive 5-year periods unless all three owners agree in writing to amend or rescind them and record the change.
