Inlet Watch is a two-part community in Wilmington, NC: Inlet Watch Yacht Club is a boat-slip membership association where you own an undivided interest in common areas (including wet and dry boat slips, pool, tennis courts, clubhouse) and a membership appurtenant to that interest; Inlet Watch Estates is a separate single-family-home HOA with its own common area (private streets, etc.). The documents are the original 1985 Declaration and By-Laws for the Yacht Club and a 1987 Declaration for the Estates HOA. These rules bind members/owners of each respective association.
- What you own & maintain (Yacht Club): You own a fee simple undivided interest in the common areas and facilities (including docks, boat slips, pool, tennis courts, clubhouse) and a membership that gives you the exclusive right to use a designated boat slip. The Association maintains all common areas and facilities, including dredging, and carries master insurance.
- What you own & maintain (Estates HOA): You own a lot in fee simple. The Association owns and maintains the common area (private streets, etc.) and carries casualty and liability insurance on it. The Association also repairs privacy fences installed by the Declarant.
- Assessments & fees (Yacht Club): Regular assessments are set by the Board based on an annual budget, allocated among classes of members by boat slip location. Special assessments over $100 per member per year require approval of two-thirds of members voting. Delinquent assessments become a lien on the membership and undivided interest, and the Association may foreclose.
- Assessments & fees (Estates HOA): Annual assessments start at a maximum of $300 per lot, can increase up to 5% per year without a vote, and above 5% require two-thirds vote of each class. Special assessments for capital improvements also require two-thirds vote. Delinquent assessments become a lien on the lot.
- Leasing & rentals (Yacht Club): A member may lease their membership (including the right to use the boat slip and common areas) to a lessee. During the lease, the lessee has all use rights, and the member retains only the right to vote. No minimum lease term is stated.
