Fairway Commons Townhomes is a planned community of townhomes in Wilmington, NC, governed by a homeowners association (the Fairway Commons Townhome Association). Each owner holds fee simple title to a lot and living unit, and shares ownership of common properties. The association maintains common areas and provides exterior maintenance for each unit, funded by regular and special assessments.
- What you own & maintain: You own your lot and living unit. The association maintains roofs, gutters, exterior surfaces (except windows and doors), trees, shrubs, grass, walks, and other exterior improvements. You are responsible for doors, windows, skylights, exterior light bulbs, and all utility systems serving your unit.
- Assessments & fees: Regular assessments are levied equally against each lot, fixed annually by the board. Special assessments require 67% member approval, except when needed to cover shortfalls. Unpaid assessments bear 18% annual interest and become a lien on the property.
- Architectural review: No exterior changes (buildings, fences, walls, landscaping, tree removal) may be made without written approval from the board or an aesthetics committee. Plans must be submitted and approved within 30 days; otherwise, approval is deemed given.
