Forest Creek is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). The rules apply to lot owners and cover property use, maintenance, assessments, and architectural standards.
- What you own & maintain: You own your lot and house; the HOA owns and maintains common areas (e.g., open spaces, stormwater facilities, private streets). You must maintain your lot (mow grass, remove trash) and keep drainage ditches clear.
- Leasing & rentals: Leases must be at least 6 months, in writing, and include a clause binding tenants to the HOA rules. Owners must provide the HOA a copy of the lease.
- Architectural review: Any exterior changes (buildings, fences, signs, major landscaping) need written approval from the Declarant (or later the HOA). Plans are reviewed for harmony of design; approval is automatic if no response within 30 days.
- Parking & vehicles: No street parking of inoperative vehicles; only one one-ton GVW truck/van per residence. Boats, campers, and RVs must be stored behind the house and screened from view. Unlicensed vehicles (e.g., go-carts) are banned if they create a nuisance.
- Pets & animals: Household pets (dogs, cats, small mammals, birds, fish) are allowed but not in commercial quantities. Livestock, poultry, monkeys, snakes, and wild animals are prohibited. Dogs must stay on your lot unless leashed.
- Assessments & fees: Annual assessments fund common area maintenance, insurance, and amenities. The maximum annual assessment was $1,200 per lot in 2005, adjustable annually up to 10% without a vote. Special assessments require 2/3 approval of voting members. Late payments incur interest (up to 18% annually) and can lead to liens.
- Use restrictions: Lots are for single-family residential use only. No business, commercial, or professional activity (except a home office with no customer traffic). No noxious activities, firearms, fireworks, or storage of flammable liquids over 5 gallons. Temporary structures (trailers, tents) cannot be used as residences.
- Stormwater & environmental rules: Maximum built-upon area per lot is 4,500 sq ft. A 30-foot vegetated buffer must be maintained between impervious surfaces and surface waters. No filling or piping of drainage ditches except for driveway crossings. Roof drains must terminate at least 30 feet from high water mark.
