The Haven at Galleria is a master-planned commercial subdivision in Wilmington, NC, not a residential community. This document establishes reciprocal easements and cost-sharing for stormwater drainage, access roads, and utilities among the owners of three large parcels (Parcel A, Parcel B, and a Future Development Parcel). It does not create a homeowners association or impose rules on individual homeowners, tenants, or renters.
- What this document covers: This is a declaration of covenants, restrictions, and reciprocal easements among the owners of three commercial parcels. It governs shared stormwater infrastructure (detention pond), access roads (Galleria Boulevard and Steadman Street), and utility easements, with cost-sharing formulas for maintenance.
- Stormwater cost sharing: Drainage maintenance costs are allocated by Pro Rata Share: Parcel A 40%, Parcel B 40%, Future Development Parcel 20%. Unpaid amounts bear 12% annual interest. Administrative fees cannot exceed 5% of actual expenses.
- Road maintenance cost sharing: Parcel B maintains Galleria Boulevard and Steadman Street (until public dedication), and Parcel A reimburses 50% of ongoing road and landscaping maintenance costs.
- Use restrictions: No portion of the property may be used for gasoline sales, laundromat/dry cleaner, adult businesses, pawn shop, bar/nightclub, gaming, check-cashing/payday loans, or marijuana-related businesses (including medical).
- Insurance requirements: Each parcel owner must maintain commercial general liability insurance with minimum limits of $1,000,000 per occurrence and $2,000,000 aggregate, and provide certificates of insurance upon request.
- Built-upon area limits: Maximum built-upon area (BUA) is allocated: Parcel A 212,949 sq ft, Parcel B 219,666 sq ft, remaining onsite 174,489 sq ft (including detention pond), and offsite 71,395 sq ft. BUA includes structures, asphalt, concrete, etc., but excludes raised open wood decking and swimming pool water surface.
- What this document doesn't cover: This document does not contain rules for individual homeowners, tenants, or renters. There are no pet restrictions, lease terms, age restrictions, architectural review for residential units, or any residential occupancy rules. It applies only to the commercial parcel owners.
