What Brookfield's governing documents say
Brookfield is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants recorded in multiple sections (Section 1, 3C, 3F). These covenants run with the land and bind all lot owners. The documents here are a 1997 amendment to Section 1's restrictions and the original declarations for Sections 3C and 3F.
- Residential use only: All lots must be used for residential purposes only. No commercial, noxious, or nuisance activities are allowed. No portion of a lot may be used as a public or private roadway except a driveway.
- Single-family dwellings & size: Only one detached single-family dwelling (max two stories) and a private garage for up to two cars are allowed. No garage apartments. Minimum living area: Section 3C requires 1,050 sq ft (or 1,000 sq ft with garage/carport/covered porch of at least 120 sq ft); Section 3F requires 1,250 sq ft (or 1,200 sq ft with such addition). Section 1 (as amended) requires 1,150 sq ft (or 1,050 sq ft with garage/carport/covered porch of at least 120 sq ft).
- Exterior finishes: Section 1 (as amended) allows exterior finishes of brick, brick veneer, stone, wood frame, masonite, vinyl, or similar modern standard materials. Sections 3C and 3F require brick, brick veneer, or wood, but other materials may be used if approved in writing by the developer (or nominee).
- Setbacks & lot lines: In Sections 3C and 3F, buildings must be at least 40 feet from the front street line and 10 feet from side lines. Section 3F has additional specific setbacks for certain lots along Gladbrook, Elder, and Springdale Drives.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock may be raised, bred, or kept. Dogs, cats, and other household pets are allowed but not for commercial purposes.
- Construction & approval: Plans and specifications must be submitted to and approved by the developer (or nominee) before construction. Approval must be given or denied within 10 days of written request; if no response, approval is not required. Construction must be completed within 4 months of starting or placing materials.
- Duration & amendment: Covenants run with the land until January 1, 1995, then automatically renew for successive 10-year periods. They may be amended or abolished by a written instrument signed by a majority of lot owners.
