Murrayville Station Business Park is a commercial/industrial planned community in Wilmington, NC, governed by a Declaration of Protective Covenants. This document binds all lot owners (fee-simple owners of commercial or industrial lots) and their tenants, occupants, and guests. It establishes a property owners association, sets use restrictions, architectural controls, and assessment obligations for the development.
- Permitted uses & zoning: Lots are zoned B-1, B-2, I-1, or I-1 conditional. Permitted uses are those allowed by New Hanover County zoning, with many specific exclusions including agricultural uses, kennels, adult entertainment, bars, discos, churches, schools, daycares, recycling facilities, and dwelling units (except for security personnel).
- Architectural review: All construction, exterior changes, and landscaping must be approved in writing by the Developer (or later the Board). The Developer has sole discretion to approve or disapprove plans based on harmony with surroundings and the development's best interests.
- Assessments & fees: Each lot owner must pay general assessments for common expenses, which can increase up to 10% per year until 1998, then are set by the Board. Special and individual assessments may also be levied. Unpaid assessments become a lien on the lot and a personal obligation of the owner at the time they fell due. A working capital contribution equal to 12 months' assessments is due at purchase.
- Parking & vehicles: No damaged vehicles may be parked or stored in open areas. Delivery vehicles cannot remain in front of buildings for extended periods. On-street parking by businesses is prohibited. Parking areas must meet setback requirements.
- Landscaping & maintenance: All property must be landscaped per approved plans and kept neatly trimmed. Owners must maintain their lots, including right-of-ways and areas to the DOT fence on NC 132. The Association may enter and perform maintenance at the owner's expense after 10 days' notice if the owner fails to maintain.
- Signs & advertising: All signs must be approved by the Developer. No outside storage or displays are allowed without written approval.
- Prohibited activities & structures: No temporary buildings, outdoor storage of non-business property (campers, boats, RVs), antennas without approval, storage tanks, or mineral exploration are allowed. Hobbies that detract from aesthetic character are not permitted in open areas.
