What The Willows at Stones Edge's governing documents say
This is a supplemental declaration for The Willows at Stones Edge, a single-family home subdivision within the larger Stones Edge community in Wilmington, NC. It amends the master declaration with specific rules about fences and easements for this phase only. The rules bind all lot owners in The Willows at Stones Edge.
- Fences & hedges: No fence or vegetative hedge may be erected without prior written approval from the Declarant. Fences must be wood or similar materials and cannot be placed nearer the front lot line than the rear corners of the residence, unless approved. Vegetable gardens must be at least 15 feet behind the back corner of the residence.
- Buffer & privacy fences: The Declarant may install buffer or privacy fences along common boundaries or along the boundary of a lot that does not adjoin another lot in The Willows. Owners of adjoining lots with such fences are jointly responsible for repair and maintenance; if a fence does not adjoin another lot, that owner is solely responsible. The Declarant may assign maintenance to the Association, and costs plus a 15% service charge may be assessed as a specific assessment.
- Easements for fences: An easement is reserved for the Declarant and Association along side and rear boundary lines (Fence Easement Area) to locate buffer/privacy fences. A separate 10-foot easement (Fence Maintenance Easement Area) along side and rear lot lines allows for installation, repair, and maintenance of those fences. No structures or plantings may interfere with these easements. If the side setback is less than 10 feet, the easement width equals the setback.
- What this document doesn't cover: This is a supplemental declaration that only modifies fence rules and easements for The Willows at Stones Edge. It does not cover other typical HOA topics such as architectural review (beyond fences), parking, pets, leasing, or assessments. Those are governed by the master Declaration for Stones Edge, which is incorporated by reference.
