Glynn Wood Estates II is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1973. These covenants apply to all lots fronting designated public roads and are binding on all owners until 1995, with automatic ten-year extensions unless changed by a majority vote.
- Land use & lot type: All lots are for single-family residential use only. No business activity, trade, or noxious activities are allowed.
- Building & structure rules: Only one detached single-family dwelling (or mobile home/trailer) per lot, plus a two-car garage and approved outbuildings. Maximum 1½ stories. Minimum 600 sq ft ground-level living area (excluding porches, garages, etc.). Setbacks: 25 ft from front, 5 ft from rear, 8 ft from side property lines. If you own two or more adjoining lots and use them for one residence, the interior boundary lines are ignored for setback purposes.
- Mobile homes & trailers: Mobile homes or house trailers are allowed but must meet Underwriter's Laboratory standards.
- Utilities & easements: All residences must connect to the developer's water system and an approved sewage disposal system. Easements are reserved for utility lines, pipes, and drainage, generally along the rear 5 ft or sidelines. No permanent structures in easements, but fences, walls, or hedges are allowed. The owner maintains the easement area.
- Signs: No signs or billboards except private name plates and 'For Sale' or 'For Rent' signs.
- Architectural review: Plans for all residences, garages, and outbuildings must be approved by the developer before construction or placement.
- Maintenance & nuisance: If a lot becomes unsightly or hazardous, the developer may enter, clean it, and charge the owner, with a lien for unpaid costs. No storage of trade materials, trucks, tractors, or inoperable automobiles. Nothing that annoys the neighborhood.
- Enforcement & amendments: Any owner can sue to enforce the covenants. The covenants run with the land until 1995, then auto-renew every 10 years unless a majority of lot owners vote to change them. Before 1995, amendments require consent of 60% of lot area owners plus the developer.
