What Arjean Subdivision's governing documents say
Arjean Subdivision is a single-family home community in Wilmington, NC, governed by a declaration of covenants and an association that provides shared recreation and boating facilities. The rules apply to all lot owners and are designed to maintain a uniform residential character.
- Residential use only: All lots must be used exclusively for residential purposes. No commercial activity, hotels, motels, or boarding houses are allowed.
- Lot and home size: Each lot must be at least 20,000 square feet. Only one detached single-family dwelling is permitted, with a minimum of 1,800 square feet of heated living area, and no more than 2.5 stories.
- Setback and location: Dwellings must be set back at least 73 feet from the centerline of Arjean Drive, except for waterfront lots.
- Architectural review: Construction plans and location must be submitted to the Developer for approval. If not approved or disapproved within 10 days, approval is not required as long as the design is in harmony with existing structures.
- Pets and animals: No farm animals, poultry, or cats are allowed. Dogs are permitted only if confined to the owner's property and not kept for commercial purposes or as a nuisance.
- Construction timeline: Once started, a structure must not remain unfinished for more than six months. A residence must be built within three years of purchasing the lot from the Developer, or the Developer may repurchase the lot.
- Recreation Association membership: Every lot owner (except waterfront lots, which may opt in) is a member of the Arjean Recreation Association, which maintains a recreation area and boat ramp. Annual dues start at $10 per lot and can be changed by the Board. Special assessments require a two-thirds vote.
- Channel Association membership: Every lot owner automatically becomes a member of the Arjean Channel Association upon recording the deed.
