What Shellbank's governing documents say
Shellbank is a single-family home subdivision in Wilmington, NC, governed by a declaration of restrictions that run with the land. These rules apply to all current and future owners of Lots 1–8 in Section 1, and cover residential use, building size and placement, and property maintenance.
- Residential use only: Lots may be used only for residential purposes; no commercial trade or activity is allowed, and no lot may be resubdivided unless each part becomes part of another whole lot.
- Building size & height: Only one detached single-family dwelling (max 2.5 stories) plus a private garage and incidental outbuildings may be built. The dwelling must have at least 1,500 square feet of interior floor area (excluding porches, steps, walks, breezeways, carports, and garages).
- Garage restrictions: A private garage for no more than three cars is allowed, must be no more than one story, and cannot be used as living quarters. Attached garages and carports should open from the side or rear of the residence where practical.
- Setback requirements: Minimum setbacks vary by lot: generally 25 ft from rear lot line, 50 ft from front lot line, and 10–15 ft from side lot lines. Corner lots and specific lots have additional or different setbacks (e.g., Lot 5: 25 ft from both street lines; Lot 8: 40 ft from Abalone Drive).
- Construction timeline: Once a structure is begun, the exterior must be completed within nine months.
- Nuisance & waste: No obnoxious trade or activity that could annoy neighbors is allowed. Rubbish, trash, and garbage must be kept in sanitary containers; incinerators must be kept clean. No surface closets or outhouses; sewage disposal must be by septic tank until a general system is installed.
- Fences & yard features: No fence may be placed beyond the front of the residence unless it is ornamental. Front yards must have an attractive ornamental yard light that is automatically controlled to come on at night. Rural mailboxes must have suitable attractive durable supports.
- Architectural review: Building designs must be approved by the developer (or designee). Upon written request, the developer has 10 days to approve or disapprove; if no response within 20 days, approval is not required as long as the design is in harmony with existing structures.
