The Reserve at Spring Creek is a planned single-family home community in Wilmington, NC, governed by a homeowners association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners. It covers assessments, architectural control, use restrictions, and maintenance obligations.
- What you own & maintain: You own your lot and the dwelling on it. You are responsible for maintaining your lot (including landscaping, storm water improvements, and the dwelling). The HOA maintains the common areas (including private streets, water/sewer lines, and the community boating facility).
- Assessments & fees: Annual assessments are capped at $2,000 per lot during declarant control. After that, the board can increase assessments up to 20% per year without a vote; larger increases require a 2/3 vote of members. Special assessments for capital improvements also require a 2/3 vote. A working capital assessment equal to two months' estimated annual assessment is due at closing.
- Architectural review: All exterior changes (buildings, fences, decks, paint colors, etc.) require prior written approval from the Architectural Control Committee (ACC). Minimum house size is 2,500 square feet of enclosed heated/cooled area (excluding garages, decks, porches). Vinyl siding is prohibited. The ACC has 10 days to approve or disapprove plans.
- Parking & vehicles: No trucks over 3/4 ton, boats, or trailers may be parked on the property except inside an enclosed garage. Inoperative or unregistered vehicles are not allowed on lots, streets, or common areas. The HOA may tow violators at the owner's expense.
- Use restrictions: Lots are for single-family residential use only. No lot may be subdivided without ACC approval. The HOA can adopt rules for use of yards and common areas.
- Utilities: Water service is provided by a private well on each lot (owner's expense). Sewage disposal is via New Hanover County sewer system; owners must connect and pay tap fees.
- Leasing & rentals: The document does not address leasing restrictions or minimum lease terms. Renters are allowed to use common areas if they reside on the property.
