What Lighthouse Cove's governing documents say
Lighthouse Cove is a single-family home HOA in Nueces County, Texas. These supplemental policies (Fine & Enforcement and Assessment Collection) are not the full rulebook; they detail how the association fines violations and collects unpaid assessments. The actual rules are in the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) recorded in 2016.
- Fines & enforcement: Fines start at $25 for a first violation (e.g., unsightly lot, unauthorized construction, landscape issues) and can increase with repeated notices up to $125 per notice. For continuing violations, the association may charge $10 per day. Before fining a curable violation, the association must send a written notice with a cure period and offer a hearing if requested within 30 days. Fines cannot be foreclosed upon.
- Assessment collection: Assessments are due on the date set by the board. Late fees are $25 per month plus interest up to 1.5% per month. The association may suspend use of common amenities if an account is delinquent for 30+ days. After 60 days delinquency, the account is referred to an attorney, and a lien may be recorded after two notices (first by email or first-class mail, then by certified mail) and a 90-day wait. Foreclosure requires board approval.
- Payment plans: The association must offer a payment plan of at least 3 months (up to 18 months) to delinquent owners who request it in writing before the cure deadline. Only one plan per 12 months, and not if the owner defaulted on a plan in the last 2 years.
- Signs (from a separate amendment): A separate 1999 amendment for the Arboretum Subdivision (Caswell Beach, NC) allows only professionally made 'for sale' or 'for rent' signs no larger than 12"x24", on a post no wider than 4" and no taller than 36", with lettering no taller than 3". Builder signs are allowed during construction only. This rule does not apply to Lighthouse Cove.
