What Landmark at Lighthouse Cove's governing documents say
Landmark at Lighthouse Cove is a planned community in Bolivia, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners. It covers property rights, assessments, use restrictions, architectural control, and stormwater management.
- What you own & maintain: You own your lot and the dwelling on it. The HOA maintains common elements (e.g., private roads, open space, stormwater ponds) and insures the townhome buildings (but not unit interiors). You must maintain your lot and structure, including keeping it free of weeds and in good repair.
- Assessments & fees: Annual assessments fund common area maintenance, insurance, and reserves. Special assessments require a 2/3 vote of owners (except for certain developer-related costs). Late payments accrue interest and can lead to liens and foreclosure. The HOA may also levy individual assessments for fines or maintenance costs.
- Leasing & rentals: Short-term rentals (e.g., VRBO, Airbnb) are prohibited. Leases must be for at least six months. No other rental restrictions are stated.
- Pets: No more than two dogs, cats, or other household pets per lot. Pit bull-type breeds (American Pit Bull Terrier, American Staffordshire Terrier, American Bully, Staffordshire Bull Terrier) are prohibited. Pets must be leashed and not become a nuisance.
- Architectural review: All exterior changes (including painting, additions, fences, mailboxes) require prior written approval from the Architectural Control Committee (or the HOA board). The committee can deny based on aesthetics. Plans not acted on within 30 days are deemed approved.
- Parking & vehicles: Boats, campers, trailers, motor homes, tractors, and inoperable vehicles are not allowed on lots or common areas without HOA consent. The HOA may tow violators at owner expense.
- Use restrictions: Lots are for residential use only. No nuisances, temporary structures as residences, clotheslines, yard statuary, fire pits, or open flames. Flags and flagpoles require approval. Satellite dishes under 18 inches not visible from the street are allowed. One 'for sale' sign per lot is permitted.
- Stormwater management: The HOA must comply with a state stormwater permit. Each lot has a maximum built-upon area of 3,500 square feet. A 50-foot vegetative setback must be maintained near surface waters. Runoff must drain into the permitted system.
