Bald Head Association is a master-planned community on Bald Head Island, NC, governed by a unified declaration of covenants, conditions, and restrictions. This document is an amendment to that declaration, updating rules on assessments, use restrictions, maintenance responsibilities, and amendment procedures. It applies to all property owners in the association.
- What this document is: This is an amendment to the Amended and Restated Unified Declaration of Covenants, Conditions and Restrictions for Bald Head Association, recorded in 2018. It modifies specific sections but does not replace the full declaration.
- Use restrictions: All units are restricted to single-family residential use only, except for certain lots owned by the Village of Bald Head Island. Home offices are allowed if they do not induce traffic, require signage, outdoor storage, or include retail space. No dwelling may be occupied by more than one family, and renting an ancillary structure while occupying the primary dwelling (or vice versa) is prohibited.
- Assessments: The Board sets general assessments at least annually, with at least 30 days' notice. Special assessments under $250 or 10% of the general assessment can be set by the Board; larger ones require a two-thirds membership vote. Improved units pay three times the assessment of unimproved units. Supplemental assessments may be levied for service areas benefiting only certain units.
- Maintenance responsibilities: Each owner must maintain their unit and grounds in a clean, neat, and sightly condition. If an owner fails to do so, the association may perform the maintenance and assess the cost plus a 20% administrative fee, after 30 days' notice.
- Amendment process: The declaration can be amended by a two-thirds vote of members present and voting (in person or by proxy). Stage Two Secondary Covenants for specific communities can be amended by a two-thirds vote of that community's members, with board approval.
