Bald Head Island Yacht Club is a non-residential condominium community in Bolivia, NC, consisting of 184 boat-slip units (each a water-and-air space) and common elements. This declaration governs the marina, not a residential neighborhood—units are for mooring a single self-propelled boat, not for living in. Unit owners automatically become members of the Yacht Club, which manages the property, collects assessments, and enforces rules.
- What you own & maintain: You own a boat slip (a defined water-and-air space) and an undivided interest in the common elements (docks, bulkheads, walkways, etc.). The Yacht Club maintains all common elements, including dredging and repairs. You are responsible for your boat and any improvements you make to your slip (with Yacht Club approval).
- Use restrictions: Each unit is limited to mooring one self-propelled boat (no houseboats, floating homes, or seaplanes). Boats must be seaworthy, insured, and equipped with a sanitary holding tank. No residential use is allowed—temporary or seasonal stays are permitted only as allowed by Yacht Club rules. Units cannot be used for regular public visits or activities that create excessive noise, utility burdens, or trash.
- Leasing & rentals: Units may be rented as transient boat slips on a weekly, monthly, or longer basis, subject to Yacht Club approval and rules. Leases must be in writing and acknowledge the governing documents. The unit owner remains fully responsible for the tenant's compliance.
- Approval to buy (Unit Owner Qualification): Before you can buy a unit, the Yacht Club must approve your financial solvency and background. The application fee is $200 (as of 2015, adjustable up to 5% per year). The Yacht Club must respond within 30 days of a complete application. Denial must be rationally related to financial or background deficiencies.
- Assessments & fees: Unit owners pay monthly (or other periodic) assessments based on their unit's allocated interest (square footage of water surface). Special assessments may be levied for capital improvements. Delinquent payments accrue 18% annual interest and late fees. The Yacht Club has a lien on the unit for unpaid assessments.
- Insurance: The Yacht Club carries liability insurance (minimum $1 million) and fidelity coverage. Unit owners may need their own insurance for personal property and liability. Insurance proceeds from damage are used first for repair or restoration.
- Alterations & improvements: No structural modifications (including dredging or filling) or changes to common elements are allowed without written Yacht Club consent. The Yacht Club may require indemnification and liability insurance for approved improvements.
