Wrightsboro Acres, Section 5 is a single-family home subdivision in Wilmington, NC, governed by a 1959 Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are enforceable by any other property owner in the subdivision.
- Residential use & dwelling type: Lots may be used only for residential purposes, and only one detached single-family dwelling (up to 2.5 stories) plus a one- or two-car garage may be built per lot.
- Setbacks & lot subdivision: Buildings must be at least 50 feet from the front street line and 10 feet from adjacent property lines. Lots cannot be re-subdivided unless the split lot merges with another whole lot.
- Prohibited residences: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence.
- Architectural review & minimum size: Building designs must be approved by the developer or a committee; if no response within 10 days, approval is not required as long as the design is in harmony with existing structures. All dwellings must be built of wood, brick, brick veneer, asbestos shingle siding, concrete blocks, tile and stucco, or concrete and stucco.
- Duration & termination: These restrictions run with the land until March 1, 1979, after which they may be waived or released.
- Sewage disposal: Until municipal sewerage is available, sewage disposal must be by septic tank approved by the North Carolina State Board of Health.
- Enforcement: Any property owner in the subdivision may sue to enforce these covenants, seeking to prevent violations or recover damages.
