Ivy Wood is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land and binds all lot owners. These rules cover what you can build, how you can use your property, and what you must maintain.
- Residential use only: Lots may be used only for residential purposes, and no commercial trade or activity is allowed.
- Building & design restrictions: Only one detached single-family dwelling (max 2.5 stories) and a private garage (max 1 story, no living quarters) per lot. Minimum dwelling size is 850 square feet (excluding garage, porches, carports). All buildings must be wood, brick, brick veneer, or concrete block with brick veneer; vinyl siding or composition board requires developer approval. Exterior structures must match the main dwelling's materials, color, and appearance.
- Setbacks & lot lines: Buildings must be at least 25 feet from the front lot line, 12.5 feet from any side street line, and 5 feet from any side lot line. Eave overhangs up to 3 feet and uncovered stoops/steps within setbacks are allowed. The developer may adjust setbacks up to 10% with the affected owner's consent.
- Architectural review: All building designs (including detached garages, storage buildings, dog houses, and additions) must be approved by the developers or their designee. If no decision is made within 10 days of a written request, approval is not required, but the design must harmonize with existing structures.
- Fences: Fences cannot exceed 6 feet in height and must not extend nearer the street than the front setback line. All fences must be the same design, height, type, and general appearance as the first fence built in the subdivision. Corner lots must have a fenced rear area at least 20x20 feet attached to the house for storing lawnmowers, bicycles, toys, grills, and materials.
- Parking & vehicles: No more than 2 motor vehicles per home, and all must be in good running order. Boats, recreational vehicles, semi-trucks, and similar vehicles may not be parked in front or side yards or on the street; they must be parked in the back yard. No mechanical or maintenance work on vehicles in front or side yards or on the street; such work may only be done in back yards.
- Pets: Only household pets are allowed, and they may not be bred or kept for commercial purposes. Pets must be kept inside, within an approved fenced area, or on a leash, and the owner is responsible for control.
- Maintenance & nuisances: Owners must keep their property neat and tidy, with no unsightly debris, litter, or junk cars. No noxious or offensive activities. Inoperative vehicles, machinery, and eyesores are prohibited. Lawns must be maintained; if not, the owner pays for cleanup. All buildings must be kept in good repair; fire-damaged premises must be cleared within 90 days.
