Windmill Park is a single-family home community in Wilmington, NC, governed by a homeowners' association (HOA). All owners of building sites are automatically members of the Windmill Park Association, Inc., which maintains common areas and enforces rules. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land.
- What you own & maintain: You own your building site and all improvements on it, and are responsible for their interior and exterior maintenance. The Association maintains all common areas, including roadways, plantings, walkways, and lighting.
- Architectural review: No building, structure, exterior alteration (including painting), or sign may be built or changed without prior written approval from the Declarant or, after all sites are sold, the Board or an architectural committee. Plans are deemed approved if no decision is made within 30 days of submission.
- Assessments & fees: Annual assessments are set by the Board and may increase up to 5% per year without a membership vote; larger increases require a two-thirds vote. Special assessments for capital improvements also require two-thirds approval. A working capital assessment equal to two months' estimated dues is due at closing.
- Use restrictions: No noxious or offensive activities, hazardous materials, or junk/inoperable vehicles (including tractor-trailers) are allowed. Antennas require written permission. Building sites may not be subdivided without consent.
- Leasing & rentals: The document does not restrict leasing terms or require owner occupancy. Tenants and occupants must comply with all declaration provisions.
- Pets: The document does not address pet limits or types, but prohibits any animal whose normal activities diminish others' enjoyment of property.
- Parking & vehicles: Inoperable vehicles and vehicles without current registration and insurance are prohibited and may be towed at owner expense.
