What Wildflower's governing documents say
Wildflower is a single-family residential subdivision in Wilmington, NC. These covenants, recorded in 1991, run with the land and bind all current and future lot owners. The developer retained extensive approval rights over construction, landscaping, and lot use, and the restrictions automatically renew every 10 years unless a majority of owners vote to change them.
- Minimum house size: Each residence must have at least 1,200 square feet of heated floor space, excluding porches, garages, and storage areas. The developer may approve a house up to 10% smaller.
- Exterior materials & roof: Exteriors must be conventional frame, wood, vinyl, hardboard, brick, clay brick, or stucco. Concrete block, aluminum siding, and tar paper are prohibited. Roofs must have a minimum 6/12 pitch and earth-tone shingles (browns, grays, blacks).
- Setbacks & site approval: No specific front setback is set, but houses must be at least 40 feet from the front lot line and 10 feet from side lines (or county minimums, whichever is greater). All building and landscaping plans require developer approval before construction.
- Tree protection: No tree with a diameter over 8 inches at ground level may be cut without written developer consent. Violation incurs a $200 penalty per tree.
- Fences & hedges: Fences and hedges require written approval. Fences facing or parallel to the street must be wood. No fence or hedge is allowed nearer the front lot line than the rear corners of the house.
- Vehicles & parking: Each lot must have a paved driveway and off-street parking for at least two cars. No inoperable vehicles, vehicles without current registration/insurance, or vehicles larger than 3/4 ton (including buses, vans, and school buses) are permitted. Boats must be stored out of street view.
- Leasing & rentals: The document does not address leasing or rental restrictions.
- Pets: Household pets are allowed subject to local ordinances and leash laws. No domesticated farm animals or fowl are permitted.
