Airlie Forest is a single-family home HOA in Wilmington, NC. You own your lot and house; the association maintains common areas and enforces rules to protect property values. This declaration governs all lots and is binding on owners, their heirs, and successors.
- What you own & maintain: You own your lot and the home on it. The association owns and maintains the common area (described in Exhibit B). You must maintain your lot and home; if you fail, the association may step in and charge you the cost plus 20%.
- Architectural review: Before any construction, landscaping, or exterior changes, you must submit plans to the Architectural Control Committee. Approval is based on compatibility with the traditional southern style, stormwater rules, and no negative impact on other lots. If no response in 30 days, plans are deemed approved. Fences, satellite dishes, and driveways have specific restrictions.
- Assessments & fees: Annual assessments start at $1,800 per lot and can increase up to 5% per year without a vote; higher increases need 2/3 member approval. Special assessments for capital improvements also require 2/3 vote. Assessments are a lien on your lot; unpaid assessments accrue 18% interest and can lead to foreclosure.
- Leasing & rentals: No lease for a term less than two months. You may delegate common area use to tenants, but you cannot use common areas yourself if you delegate to a tenant.
- Parking & vehicles: No parking of tractor/trailer trucks, heavy construction equipment, boats, campers, trailers, or mobile homes on lots or association property without written consent. The association may restrict other vehicles based on size or weight.
