Summer Oaks is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1990. These covenants run with the land and bind all lot owners, promoting a uniform residential character.
- Land use & building type: Lots are for single-family residential use only. Each lot may have one detached single-family dwelling (max 2.5 stories) and one detached storage building or garage (max 400 sq ft, 1 story, no living quarters).
- Minimum dwelling size: Dwellings must be at least 850 square feet, excluding porches, garages, and carports, measured from exterior walls.
- Setbacks & building lines: Front setback: 30 ft; rear: 20 ft; side: 8.5 ft (interior lot) or 12.5 ft (corner lot adjoining street). Eave overhangs up to 3 ft and uncovered stoops/steps are allowed within setbacks. Unintentional violations may be adjusted up to 10% with owner consent.
- Architectural review: All building designs (including storage buildings, garages, dog houses, additions) must be approved by WHFD. WHFD has 10 days to respond; if no response, approval is not required, but design must harmonize with existing structures.
- Exterior materials & appearance: Dwellings must be wood, brick, brick veneer, concrete block with brick veneer, vinyl siding, composition board, or other approved synthetic material. Exterior storage buildings and additions must match the main dwelling's materials, color, and general appearance.
- Fences: Fences over 6 ft high cannot extend nearer the street than the front setback. All fences must be the same design, height, type, and appearance as the first fence approved by WHFD. Corner lots must have a fenced rear area (at least 20x20 ft) attached to the house for storing lawn mowers, bicycles, toys, grills, and stored materials.
- Property maintenance & nuisances: Owners must keep lots neat and tidy, free of debris and litter. No noxious or offensive trades/activities. Junk cars, inoperative machinery, and eyesores are prohibited. Mechanical work on vehicles allowed only in back yards. Boats, RVs, semi-trucks must be parked in back yard. Maximum 3 motor vehicles per home, all in good running order.
