This document is the declaration of condominium that establishes the condominium regime, defines unit boundaries, common elements, and the association's powers. It is intended for commercial property owners, investors, and tenants.
- What you own & maintain: Each unit consists of unenclosed ground and air space within its perimeter boundaries. Unit owners maintain their own units, including window coverings (which must be uniform from the exterior). The association maintains all common elements (e.g., paved areas, parking, drainage, landscaping). Limited common elements (e.g., HVAC components serving a single unit) are maintained by the association but the cost is assessed to the benefiting unit(s).
- Use restrictions: Units are restricted to office use as allowed in the heavy industrial (I-2) zoning district. Only letter signage affixed to the exterior door (a limited common element) is permitted. A common trash receptacle is shared, and garbage service is contracted by the association as a common expense.
- Leasing & rentals: Leases must be for a term of at least 12 months. All leases must be in writing and comply with the condominium documents. Leases are deemed to include a provision that the tenant recognizes the association as landlord for enforcement purposes, provided the association gives the owner notice and an opportunity to cure.
