All lot owners are automatically members of the Shinn Creek Estates Homeowners Association, Inc., which maintains common areas and enforces the rules. The declaration governs lot use, architectural standards, assessments, and common area rights.
- What you own & maintain: You own your lot and the house on it. The Association maintains common areas (roadways, plantings, walkways, drainage, lighting) and utility easements. You must maintain your lot free of weeds, debris, and unsightly conditions; the Association can enter and remediate at your expense after notice.
- Architectural review: All exterior changes (structures, paint, fences, landscaping) require prior written approval from the Declarant or an Architectural Control Committee. Minimum house size is 2,700 sq ft enclosed (excluding garage, decks, porches). Construction must be completed within 12 months. Landscaping must include sodded front yard, irrigation, and at least six 2" caliper trees (live oak, yaupon, or bald cypress).
- Assessments & fees: Quarterly assessments begin the day after you buy the lot. Annual increases are capped at 5% without a 2/3 member vote. Special assessments for capital improvements also require 2/3 approval. A working capital fee equal to one quarter's assessment is due at closing. Assessments are a lien on the lot; unpaid amounts bear interest and may be foreclosed.
- Leasing & rentals: Leases must be for at least six months. Owners may delegate common area use to tenants who reside on the property.
- Pets: Household pets (dogs, cats) are allowed but not for commercial purposes. They must be leashed or controlled and not become a nuisance. No livestock or poultry.
- Parking & vehicles: Off-street parking for at least 4 cars must be provided. No inoperable or unregistered vehicles; no tractor-trailers. Boats, campers, RVs must be parked behind the house and not visible from the street. Vehicle repairs only in garages, not driveways.
- Use restrictions: Lots are for single-family residential use only. No noxious activities, temporary structures as residences, or signs without Board approval. Window coverings visible from outside must be white or neutral. Exterior lights must be clear, white, or non-frost. No satellite dishes or outside antennas without permission.
