Green Arbor Pointe is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). The HOA maintains common areas (including private streets and water lines) and enforces rules for all lot owners. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land.
- What you own & maintain: You own your lot and the home on it. The HOA owns and maintains the common areas (private streets, water/sewer lines outside lots, and other shared land). You must keep your lot neat and orderly; if you don't, the HOA may step in and charge you the cost plus a 15% service fee.
- Assessments & fees: Annual assessments are shared equally per lot. The maximum annual assessment was $1,800 per lot until the third anniversary of the declaration (1988). After that, the board can increase it up to 10% per year without a vote; larger increases require a 2/3 vote of members. Special assessments for capital improvements also require a 2/3 vote. Assessments are a lien on the lot and bear 12% interest if delinquent.
- Architectural review: No exterior changes (buildings, fences, signs, antennas, satellite dishes, etc.) may be made without written approval from the Architectural Committee. Plans must be submitted; if the committee doesn't respond within 30 days, approval is deemed given. The initial committee consists of Howard H. Hess, Jill Moeller, and Gregory A. Hess.
- Leasing & rentals: Leases must be for at least 30 days (no short-term or transient rentals). You cannot lease less than the entire home. Every lease must be in writing and state that the tenant must follow the HOA's rules.
- Parking & vehicles: Each lot must provide off-street parking. No parking on streets or common areas. Trucks, boats, trailers, and commercial vehicles may only be stored inside an enclosed garage.
- Pets: Only dogs, cats, or other household pets are allowed, and they must be kept inside the home. No commercial breeding or keeping of livestock or poultry.
- Use restrictions: All lots and homes are for residential use only. No business, trade, or profession is allowed (except Declarant may use up to two homes for sales/display). No signs are allowed except 'For Sale' or 'For Rent' signs by the owner. Minimum home size is 1,400 square feet (excluding porches, decks, and garages).
