Seapath Estates is a single-family home HOA in Wrightsville Beach, NC. The rules apply to all lot owners and their tenants. The community includes a yacht basin and common area maintained by the association.
- What you own & maintain: You own your lot and the dwelling on it. You must maintain your property to prevent unsightly conditions. The association maintains the common area, including streets, yacht basin, and sea wall, funded by assessments.
- Architectural review: No building, fence, wall, or other structure may be erected or altered, and no grading or dune changes may be made, without prior approval from the Board of Directors. Houses must have at least 1,500 square feet of enclosed heated area (excluding garages, porches, decks). Exteriors must be completed within 12 months of starting construction.
- Residential use & restrictions: All lots are for single-family residential use only. No trailers, tents, or temporary structures (except contractor shelters during construction). No commercial, noxious, or offensive activities. Fuel tanks must be hidden or buried. Only road-licensed vehicles allowed; unlicensed vehicles must be in an enclosed garage. Boats up to 16 feet may be kept on lots near the sea wall if orderly.
- Pets: Only domesticated house pets are allowed, and they must be housed inside your residence (no separate runs or outdoor lots). Pets must be leashed or under control outside, and must not create unsightly or unhealthy conditions in common areas.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars before occupying the dwelling. Only vehicles with current road licenses are allowed; others must be stored in an enclosed garage (carports not sufficient). Boats on trailers must be stored similarly.
- Assessments & fees: All lot owners pay annual assessments set by the Board at a uniform rate. The first annual assessment was $60. Assessments are due annually and become a lien on the property if unpaid, with 8% annual interest. The lien is subordinate to first mortgages.
- Common area & amenities: Every owner has an easement to use the common area, which includes streets, yacht basin, and adjoining area. The association may set rules for use. Owners may delegate use to family, tenants, or contract purchasers who live on the property. The association can suspend voting rights and facility use for unpaid assessments or rule infractions.
