What Channel Walk Townhouses's governing documents say
Channel Walk Townhouses is a townhome community in Wilmington, NC, where you own your lot and a single-family townhouse dwelling, and share ownership of common areas with other owners. The homeowners association maintains the common areas and provides exterior maintenance for each lot, funded by annual assessments.
- What you own & maintain: You own your lot and the townhouse on it. The association handles exterior maintenance (roofs, gutters, exterior surfaces, landscaping) but not glass surfaces. If damage is caused by your negligence or certain perils, the repair cost is added to your assessment.
- Assessments & fees: Annual assessments are levied per lot, initially capped at $216 per year, and can increase up to 3% annually without a vote. Special assessments for capital improvements require a two-thirds vote of each membership class. Assessments are a lien on the property and bear 8% interest if unpaid after 30 days.
- Architectural review: No building, fence, wall, or exterior alteration may be made without written approval from the board or an architectural committee. Plans must be submitted; if no decision within 30 days, approval is deemed given.
- Party walls: Walls on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. Disputes are resolved by arbitration.
- Use restrictions: Lots are for residential use only, with one single-family townhouse not exceeding 2.5 stories. No temporary structures, trailers, or outbuildings may be used as residences. No noxious or offensive activities are allowed.
- Common area & amenities: Owners have an easement to use common areas, but the association may charge fees for recreational facilities. Voting rights and facility use can be suspended for unpaid assessments or rule violations (up to 60 days). Common areas may be dedicated to a public agency with a two-thirds vote.
- Leasing & rentals: Owners may delegate their common area use rights to tenants who reside on the property. No other rental restrictions are stated in this document.
- What this document doesn't cover: This document does not specify pet rules, parking regulations, age restrictions, or rental term minimums. It is the original declaration from 1972; amendments or later rules may add such restrictions.
