Covey Commons is a planned community in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners, residents, and guests. It establishes the HOA, sets rules for property use and maintenance, and outlines assessments and enforcement.
- What you own & maintain: You own your lot and any dwelling on it. The HOA owns and maintains common elements (e.g., private roads, stormwater ponds, open space). You must keep your lot free of weeds, debris, and unsightly conditions, and maintain all structures in good repair.
- Assessments & fees: Annual assessments fund common area maintenance, insurance, and operations. Special assessments require 2/3 owner vote (except for certain developer-related costs). A $200 working capital fee is due at closing. Assessments are a personal obligation and a lien on the lot if unpaid.
- Architectural review: All exterior changes (structures, painting, fences, solar panels) require prior written approval from the Architectural Control Committee (or the developer during the Declarant Control Period). The committee has sole discretion based on aesthetics and harmony with surroundings.
- Use restrictions: Lots are for single-family residential use only. Minimum heated floor area is 1,800 sq ft. No temporary structures, boats, campers, inoperable vehicles, or commercial vehicles may be stored on lots or streets. Clotheslines are prohibited. Centralized mailboxes are provided; no individual mailboxes.
- Pets: Domestic dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and controlled at all times. The HOA may adopt rules on number, type, and size of pets.
- Leasing & rentals: The document does not impose minimum lease terms or restrict the number of rentals. However, all tenants must comply with the declaration and HOA rules.
- Stormwater & environmental restrictions: The property is subject to a stormwater permit. Maximum built-upon area per lot is 4,500 sq ft. A 30-foot vegetated buffer must be maintained between impervious areas and surface waters. Runoff must drain into the permitted system. The HOA is responsible for maintaining stormwater facilities.
- Developer rights & transition: The developer (Harbor Island Investors, LLC) retains special rights, including control of the HOA board until December 31, 2026, or until certain conditions are met.
