Harbor Villa is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all lot owners and are designed to maintain a uniform, residential character.
- Residential use only: Lots may only be used for residential purposes. No commercial, noxious, or nuisance activities are allowed. Temporary structures, trailers, mobile homes, tents, and outbuildings cannot be used as residences.
- Building & design standards: Only one detached single-family dwelling (max 2 stories) and a private garage (max 1 story, no living quarters) are permitted. Minimum living area is 1,200 square feet (excluding porches, garages, carports). At least 60% of exterior finish (excluding roof) must be brick, brick veneer, or stone.
- Setbacks & lot orientation: Front setbacks vary by lot: 50 ft for lots 44-51, 59-60, 63-64; 55 ft for lots 42-43, 61-62, 68; 60 ft for lots 32-41, 52-58, 65-67. Side setbacks are at least 10 ft. Specific lots have required street frontage (e.g., lot 63 faces Del Rio Avenue).
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, and other household pets are allowed but cannot be kept, bred, or maintained for commercial purposes.
- Waste & sanitation: No dumping of rubbish, trash, garbage, or waste. Waste must be kept in sanitary containers. Incinerators must be clean. No surface closets or outhouses; sewage disposal must be by septic tank until a general system is installed.
- Lot subdivision & changes: No lot may be subdivided or its layout changed unless the subdivided part becomes part of a whole lot and the remainder becomes part of another whole lot.
- Duration & enforcement: Covenants run for 10 years from November 30, 1966, and automatically renew for successive 10-year periods unless a majority of lot owners record a change. Any lot owner may enforce the covenants through legal proceedings.
