Sea Breeze Sound is a single-family home HOA in Wilmington, NC. This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that binds all lot owners. It covers property rights, assessments, architectural control, use restrictions, and maintenance obligations.
- What you own & maintain: You own your lot and dwelling. The association maintains common areas (open space, piers, etc.) and may enter your lot for emergency repairs or remedial maintenance. You must keep your lot free of weeds and debris.
- Architectural review: An architectural committee must approve all exterior changes (buildings, landscaping, color changes, etc.) before you start. Approval is based on harmony of design and subjective aesthetic judgment. The committee has 60 days to respond; if they don't, your application is approved.
- Leasing & rentals: The document does not restrict leasing. However, all owners, tenants, and occupants must comply with the Declaration.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and not become a nuisance. You must clean up pet waste on common areas and roads.
- Parking & vehicles: No campers, trailers, mobile homes, inoperable vehicles, or vehicles without current registration/insurance may remain on any lot or street. Vehicle repairs must be done in garages or out of street view. The association may tow violators at owner expense.
- Assessments & fees: The association levies annual assessments based on an adopted budget, plus special assessments for capital improvements (with majority vote) and insurance assessments. Assessments are a lien on your lot if unpaid. The first assessment is set by the developer.
- Use restrictions: Lots are for residential use only. No nuisances, temporary structures as residences, or subdividing without consent. Christmas decorations allowed Nov 20–Jan 7. Only US and NC flags allowed, no vertical poles, max 4'x6'. No political signs. Satellite dishes under 18 inches not visible from street are allowed.
- Environmental restrictions: Wetland preservation areas must remain natural. Stormwater management limits built-upon area per lot; you cannot pipe or fill swales/ditches except for driveway culverts. A 30-foot vegetated buffer is required between impervious surfaces and surface waters.
