Scott's Hill Village is a standard single-family home HOA in Wilmington, NC. This declaration of covenants, conditions, and restrictions (CC&Rs) binds all lot owners, their tenants, and guests. It establishes the homeowners association, sets rules for property use and appearance, and creates a lien-based assessment system.
- What you own & maintain: You own your lot and dwelling. The association maintains common areas, entrance signs, street lights, stormwater facilities, roads (unless accepted by a government entity), sidewalks, and other amenities it owns. You must keep your lot free of weeds, underbrush, and unsightly objects; the association can enter and clean at your expense after 30 days' notice.
- Architectural review: An architectural control committee must approve all exterior changes, including buildings, fences, landscaping, color changes, and additions. Approval is not needed for interior work or restoration identical to previously approved work. The committee has 60 days to respond; failure to act within 75 days is deemed approval. The developer retains control of the committee until it owns no lots.
- Use restrictions: Lots are for residential use only. Minimum dwelling size is 1,800 heated square feet. No temporary structures, trailers, or tents as residences. No inoperable vehicles; no vehicle repairs visible from the street. Pets (dogs, cats, household pets) are allowed but must be leashed and not a nuisance; owners must dispose of waste. No yard statuary or satellite dishes over 18 inches visible from the street. Christmas decorations only Nov 20–Jan 7. Only U.S. and North Carolina flags allowed, no vertical poles, max 4'x6'. No political signs. No nuisances.
- Assessments & fees: The association levies annual assessments based on an adopted budget. Special assessments for capital improvements require a majority vote of owners. Insurance assessments may be added. Assessments are a personal obligation and a lien on the lot if unpaid after 30 days. The association can foreclose like a mortgage. First mortgage holders who acquire title through foreclosure are not liable for prior unpaid assessments.
- Leasing & rentals: The document does not restrict leasing terms or require association approval for rentals. However, all tenants must comply with the declaration.
- Insurance: The association must carry casualty and liability insurance on common areas (minimum $1,000,000 bodily injury/property damage). Each lot owner must insure their own dwelling for full replacement value. The association may obtain fidelity bonds for those handling funds.
- Environmental restrictions: Wetland areas must remain in a natural condition; certain activities (nature trails, removal of poison ivy, storm damage repair) are allowed without Corps consent. Stormwater management limits built-upon area per lot (see permit Exhibit A); a 50-foot vegetated buffer must be maintained between impervious surfaces and surface waters. These covenants require state approval to change.
