What Scotts Hill's governing documents say
This is a stormwater covenant document for Scotts Hill, a commercial development in Wilmington, NC. It binds the landowners (Comet Scotts Hill, LLC and Comet Scotts Hill MOB, LLC) and future owners of the two tracts to comply with state stormwater regulations. It is not a full homeowners' association rulebook.
- Stormwater compliance: The property must comply with North Carolina stormwater rules and permits (Master Permit SW8 080624 and SW8 230401). The covenant runs with the land and cannot be altered without state approval.
- Built-upon area limits: Tract 3-A (11.73 acres) has a maximum built-upon area of 183,315 sq ft; Tract 3-B (3.14 acres) has 100,932 sq ft. Built-upon area includes structures, asphalt, concrete, gravel, brick, stone, slate, coquina, and parking areas, but excludes raised open wood decking and swimming pool water surfaces.
- Drainage requirements: All runoff from built-upon areas must drain into the permitted stormwater system. Lots that naturally drain into the system are not required to add extra measures.
- Vegetated buffer: A 50-foot wide vegetated buffer must be maintained between all impervious areas and surface waters.
- Permit for construction: Each lot not retained by the original permittee must obtain a separate stormwater permit from the state before any construction.
- Declarant's right to adjust limits: The Declarant may recalculate and reallocate built-upon area among lots as state permits are modified, provided it complies with state rules.
- What this document doesn't cover: This document does not cover typical HOA rules such as pet restrictions, leasing, architectural review, parking, or age restrictions. It is a limited stormwater covenant only.
