What Sandollar Shores's governing documents say
Sandollar Shores is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). The rules apply to all lot owners and residents, focusing on residential use, architectural control, and shared amenities like a community boat basin.
- Residential use & lot restrictions: All lots are for single-family residential use only. No temporary structures, trailers, tents, or barns are allowed (except contractor shelters during construction). Existing barn on Lot 8 may remain if renovated and not used for human occupancy. Lots cannot be subdivided without Harken's consent.
- Architectural review: No building, fence, wall, or other structure may be erected or altered, and no grading or landscaping changes may be made, without prior written approval of Harken (or later the HOA board). Approval may be denied for any reason, including aesthetic or environmental concerns. Two copies of plans must be submitted.
- Maintenance & nuisances: Owners must keep lots clean and free of rubbish, inoperative junk cars, and unsightly conditions. No noxious or offensive activities are allowed. Livestock is prohibited; dogs, cats, and other household pets are allowed but not for commercial purposes and must not become a nuisance.
- Assessments & fees: Annual assessments (initially max $300 per lot) and special assessments for capital improvements are levied by the HOA. Assessments are a lien on the lot and a personal obligation of the owner at the time due. Unpaid assessments accrue 15% annual interest and may be foreclosed. The lien is subordinate to first mortgages.
- Common areas & boat basin: Common areas include the community boat basin with 20 boat slips. Each of the 12 lots is entitled to one slip; remaining slips may be assigned to additional lots if the subdivision expands. Boat slips are appurtenant to lots and cannot be sold separately. Boats cannot be used as residences. The HOA may regulate common area use.
- Signs: No signs or billboards are allowed except private name plates or 'For Sale'/'For Rent' signs, each not exceeding five square feet.
- Leasing & rentals: The document does not address leasing or rental restrictions beyond allowing owners to delegate common area use to tenants. No minimum lease term or rental cap is stated.
