Villas Del Mar Duets is a townhome community in Wilmington, NC, consisting of four fee-simple townhomes arranged in two-unit buildings. These deed restrictions bind all owners and occupants, and are enforced by the owners themselves (no homeowners association). The rules cover exterior maintenance, shared party walls and roofs, leasing, pets, parking, and other use restrictions.
- What you own & maintain: You own your townhome and lot in fee simple. You are responsible for maintaining your own unit and lot, including the roof. Shared structures (party walls, shared roofs, walkways) are maintained jointly with your adjoining owner.
- Leasing & rentals: Leasing is permitted, including short-term rentals (e.g., Airbnb, VRBO). Tenants must comply with all restrictions, and owners remain responsible for tenant compliance.
- Occupancy limits: No more than three unrelated persons may dwell in any townhome. 'Unrelated' excludes children, stepchildren, parents, stepparents, grandparents, grandchildren, siblings, and stepsiblings.
- Pets: No more than two common household pets (dogs, cats, etc.) per townhome unless approved by the adjoining owner. No livestock or poultry. Pets must be leashed outside, and owners must clean up droppings. No pet runs, dog houses, or chaining.
- Parking & vehicles: Vehicles must be parked in garages or driveways without obstructing sidewalks. Disabled, inoperable, or unlicensed vehicles, boats, RVs, and commercial vehicles are prohibited from overnight parking except inside a closed garage. Commercial vehicles allowed temporarily during business hours for service.
- Exterior changes & approval: Substantial exterior changes (costing $5,000+ or altering the original appearance) require prior written approval from the adjoining owner. If no response within 30 days, approval is deemed given. Disputes go to arbitration. Rear yard improvements do not need approval.
- Noise & nuisance: No obnoxious, offensive, or unlawful activity. No barking dogs. Quiet hours after 10:00 p.m. unless adjoining owner permits otherwise.
- Signs & flags: Only standard 'For Sale' or 'For Rent' signs are allowed. Political signs may be posted no earlier than 30 days before an election and must be removed within 7 days after; no more than two signs per lot at a time.
