Pleasure Cay Subdivision is a single-family and duplex residential community in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. The rules apply to all lot owners and are enforced by any property owner in the subdivision.
- Permitted uses & lot types: All lots except 23A–78A must be used for single-family residential purposes (one or two stories). Lots 23A–78A are for motor vehicle parking and canal access only, and cannot be rented or sold separately from the corresponding interior lot. Duplex units are allowed on all residential lots.
- Minimum home sizes: Single-family homes on Lots 1–22 must be at least 1,300 sq ft; on other residential lots, at least 1,100 sq ft. Single-story duplexes on Lots 1–22 must be at least 2,000 sq ft; on other lots, 1,800 sq ft. Two-story duplexes on Lots 1–22 must be at least 2,200 sq ft; on other lots, 1,800 sq ft. Measurements are by exterior brickwork or framework, excluding porches, steps, garages, etc.
- Exterior materials: Only conventional frame or clay brick exteriors are permitted. Concrete block, concrete brick, aluminum siding, cinder block, and composition tar paper are prohibited.
- Setbacks & lot subdivision: Buildings must meet the minimum front and side setbacks of Carolina Beach zoning ordinances. Corner lots treat the street with least frontage as the front. No lot may be resubdivided unless each portion becomes part of another whole lot.
- Temporary structures & signs: No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences. Signs are limited to private name plates, identification signs, and 'For Rent' or 'For Sale' signs.
- Fences: Fences cannot exceed 4 feet in height, must be set back behind the rear corners of the house, and must be made of wood or chain-link only. Chicken wire and other wire materials are prohibited.
- Canal lots & piers: Owners of Lots 1–22 may build piers up to 10 feet into Pleasure Cay Canal, must dock boats parallel to the bulkhead, and total pier + boat length cannot exceed 20 feet from the bulkhead. Owners of Lots 23A–78A may build piers up to 20 feet, must not impede adjacent owners, and total pier + boat length cannot exceed 28 feet.
- Nuisances, animals & maintenance: No noxious or offensive activities. Only domesticated household pets are allowed; farm animals and fowl are prohibited. Yards must be properly maintained; if not, the developer may clean up at the owner's expense (creating a lien). Inoperative junk cars, large trucks, and buses are prohibited, but recreational vehicles may be stored.
