Allen's Landing is a single-family home community in Wilmington, NC, governed by a homeowners association (HOA). The rules apply to all lot owners and residents, focusing on maintaining an attractive, residential character with strict construction and design standards.
- Residential use only: All lots are for single-family residential use only. No commercial or other non-residential activities are allowed.
- Minimum home size: New dwellings must have at least 2,200 sq ft (single-story), 2,500 sq ft (two-story), or 3,200 sq ft (three-story) of heated floor space. Garages are not counted. The existing cottage on Lot 1 is exempt but limited to 1,500 sq ft.
- Construction & exterior materials: Exterior materials must be first-class conventional materials like stone, brick, pine, cedar, or rendered facings. Prohibited materials include concrete/cinder blocks, steel/aluminum/asbestos siding, tar paper, and unfinished plywood. Plans must be approved before construction.
- Setbacks & views: To preserve views of Pages Creek, detailed plans and elevations must be submitted for approval. The declarant has absolute right to approve or reject any construction.
- Stormwater & impervious surfaces: No more than 6,250 sq ft of any lot may be covered by impervious surfaces (excluding wood decking and pool water). Swales may not be filled or piped except for minimum driveway crossings.
- Tree removal: Trees or shrubs with a caliper over 4 inches (measured at 4 feet above grade) may not be cut without written approval. Violation results in a $1,000 fine per tree.
- Pets: No more than 4 household pets of any one kind per lot. Pets must be tagged/licensed. Purpose breeding is prohibited. Livestock, poultry, bees, and other animals that may interfere with quietude are not allowed.
