Magnolia Heights is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants recorded in 1955. These covenants apply to all lots in the subdivision and are binding on current and future owners.
- Residential use only: Lots may only be used for residential purposes. Only one detached single-family dwelling (up to 2.5 stories) and a one- or two-car garage are allowed per lot.
- Minimum house size: Dwellings must have at least 1,100 square feet of interior area. If interior space is less, the combined area of porch space and garage under the main roof must total at least 1,100 square feet.
- Construction materials: Dwellings must be built of wood, brick, brick veneer, asbestos shingle siding, concrete, concrete blocks, tile and stucco, or concrete and stucco. Garages must use the same materials as the dwelling.
- Setback requirements: Dwellings must be at least 50 feet from the front lot line and 10 feet from side lot lines. Unattached garages or outbuildings must be at least 75 feet from the front lot line and 5 feet from side lot lines. These setbacks do not apply to Lot No. 5.
- No temporary residences: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence.
- Subdivision of lots: No lot may be re-subdivided unless the subdivided part becomes part of a whole lot and the remainder becomes part of another whole lot.
- Enforcement: Any owner of property in the subdivision may sue to enforce these covenants, seeking to stop violations or recover damages.
