The Woods at Murrayville is a planned community of single-family homes in Wilmington, NC, governed by a homeowners association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners, residents, and guests.
- What you own & maintain: You own your lot and the single-family home on it. The HOA owns and maintains the common areas (including private streets, walking trails, open space, and stormwater areas) and may charge assessments for their upkeep.
- Assessments & fees: Annual assessments start at $300 per lot per year (prorated from your closing date) and can increase up to 5% yearly without a vote. A one-time $200 transfer fee is due at closing. A working capital assessment equal to two months' estimated assessment is also due at closing. Late payments incur a 10% late fee and 12% annual interest.
- Architectural review: All exterior changes (buildings, fences, additions) require written approval from the HOA's Architectural Committee or Board. Plans are deemed approved if not acted on within 30 days after all requested data is submitted. Minimum house size is 1,200 square feet of enclosed dwelling area (excluding garages, decks, porches).
- Use restrictions: Lots are for single-family residential use only. No commercial or business activity is allowed without HOA approval. No more than three unrelated persons may occupy a dwelling. No inoperable vehicles, boats, campers, or trailers may be kept on lots unless stored out of sight in a garage. No above-ground pools, clotheslines, or chain-link fences are allowed. Pets (dogs, cats) are allowed but must be leashed and not roam free.
- Parking & vehicles: Each lot must provide off-street parking for 2–3 passenger vehicles on a paved surface. Overnight street parking is prohibited. Inoperable or unregistered vehicles may be towed at owner expense.
- Leasing & rentals: Lot owners may lease their home, and tenants may use the common areas. The document does not specify a minimum lease term or other rental restrictions beyond requiring compliance with all rules.
- Enforcement & fines: The HOA can levy reasonable fines for rule violations, which may become liens on the property and be enforced by foreclosure. Owners are given notice and a hearing opportunity before fines are imposed.
